TINSAPONO SWISS SARL is a company based in Switzerland that designs and manufactures high quality cosmetic products based on natural products, the company sells cosmetic ingredients on behalf of individuals and professionals. TINSAPONO SWISS SARL provides workshops for adults with the aim of creating natural cosmetics for private and non-professional use. The Customer adheres to the Terms of Sale and Terms of Delivery of the Products as well as the Legal Notice and Terms of Use of the website www.tinsapono.com governing the contractual relationship between himself (individual or legal entity) and TINSAPONO SWISS SARL, in particular when purchasing a Product by the Customer on the website www.tinsapono.com
The Customer of the site www.tinsapono.com declares to be domiciled in Switzerland or in one of the countries of the European Community, to be capable of contracting under the law and if necessary, validly represent the person for whom it is committed.
The Customer of the website www.tinsapono.com declares to have the competence and the necessary means to subscribe, access and use the services offered by TINSAPONO SWISS SARL.
Description of the Products

The Products are more fully described in the pages of the site www.tinsapono.com
The prices are specified on the site www.tinsapono.com for each of the Products, as well as the delivery costs related to their shipment to the address chosen by the Customer. The total cost of the selected Product, including taxes and delivery, is described on the site www.tinsapono.com and is summarized at the time of validation of the order by the Customer.
Validation of the order
After having read the description of the different Products offered, their prices, the Terms of Use, the Legal Notice, the Terms of Sale and the Terms of Delivery, the Customer selects the Product(s) he/she wishes to order as well as the delivery method of the Products.
By placing an order, the Customer acknowledges having read the special conditions of sale contained in the pages of the website www.tinsapono.com which describe the Product (name, price, brand, weight, quantity, color, size, technical specifications and use, guarantees, etc.) and expressly declares to accept them without reservation.
At the time of the validation of the order, the Customer will have the possibility:

- To reread, print and save the General Conditions
TINSAPONO SWISS SARL reserves the right to proceed to a validation of the identity of the Customer before the delivery of the Product to the Customer.
TINSAPONO SWISS SARL reserves the right not to honor an order when the Customer who places it is the subject of an ongoing dispute for lack of total or partial payment of a previous order, or for any other reason, with TINSAPONO SWISS SARL.
Validity of the information provided
The Customer of the website www.tinsapono.com undertakes to provide real, accurate and up-to-date information at the time of their entry in the registration form of the service.
In the contrary hypothesis, TINSAPONO SWISS SARL declines any responsibility in the absence of delivery, total or partial, of the Products ordered by the Customer.
Prices
The prices are in Swiss francs: CHF
TINSAPONO SWISS SARL reserves the right to modify the prices of its Products at any time according to the procedure described in the "modifications of the General Conditions of Sale".
In any case, the Products will be invoiced on the basis of the price of the Products displayed at the time of the Acceptance.
Payment and billing
Payment for Products ordered is made by:
- Visa or Mastercard
- Post-finance
- TWINT
- Bank transfer
The online payment service is secure but does not include any additional insurance policy, especially in case of theft of the customer's credit card.
In case of unpaid invoices due to fraudulent use of a payment method, TINSAPONO SWISS SARL reserves the right to charge the Customer additional fees.
It is the Customer's responsibility to check the payment submission form before any Acceptance.
In any case, TINSAPONO SWISS SARL can not be held responsible for problems or delays related to the operation of payment procedures.
The amounts paid in the context of an online payment can in no case be qualified as a deposit or advance.
When the goods are received at the warehouse, the cost price of the box used for the order will be charged (between CHF 2.00 and CHF 5.00) depending on the volume of the order.
The payment (transfer or twint) of the total cost of the order must be received on the account of TINSAPONO NATURAL COSMETICS SWISS SARL within 10 days from the validation of the order. Passed this time, the order will be cancelled and not sent.
For reasons of logistics, if the purchaser forgets to order one or more products, those could not be added by the preparers and will have to be the subject of a new order.
Modification of the General Terms and Conditions of Sale
TINSAPONO SWISS SARL reserves the right to modify and complete the present General Terms and Conditions of Sale as well as the scope of its service towards the Customer of the website www.tinsapono.com
These modifications will come into effect at the time of their publication on the website www.tinsapono.com, it being understood that the price of the Product will in any case be the one displayed at the time of the Acceptance.
Delivery services
Subject to specific stipulation, and from the day of the preparation of the order, the ordered Products will be delivered in the Delivery Territory.
Shipping costs are not included in the prices of the Products as displayed on the pages of www.tinsapono.com describing the Products. However, at the time of the validation of the order, the price will include the costs related to the delivery of the Products.
When the Customer places an order for several Products at the same time and these have different delivery dates, the delivery date of the order will be based on the most distant date so that all the Products can be delivered at the same time.
Delivery
The delivery times are expressed as follows, treatment of the order, from 1 to 5 working days (Saturdays and public holidays not being considered as working days)
Once the order is processed, Swiss Post will send the package according to the chosen shipment.
The initially announced delivery times may exceptionally be delayed in case of stock shortage.
In case of delay in shipment, i.e. 15 days after the order has been validated and paid, an e-mail will be sent by www.tinsapono.com to the Customer.
In accordance with the legal provisions, in the event that the delay in delivery exceeds 7 days from the date initially scheduled, the Customer has the option of cancelling the order within 30 working days provided that the Product is returned complete and in its original condition to TINSAPONO SWISS SARL.
TINSAPONO SWISS SARL collaborates with the Swiss Post for the delivery of products, depending on the formula chosen by the customer for the shipment, it is impossible to manage special requests concerning changes in delivery, packages to be delivered at specific times and other specific requests.
Absence of any responsibility relating to the delivery in particular in the following cases:
- Return of a package due to an address error or an incomplete address. The package can be reshipped against payment of new shipping costs.
- Return of the parcel following the non-recovery of the parcel within the time limit set by the delivery service provider. A new parcel can be sent on request of the customer, being the subject of a new invoicing with load of the customer.
Claims
The ownership of the Products is transferred upon acceptance of the delivery, it is the Customer's responsibility to check the package upon receipt, to make any reservations and claims that would appear justified to the deliverer.
If the delivered Products are not in conformity in kind or in quality with the specifications indicated in the delivery note, the said reservations and complaints must then be addressed to TINSAPONO SWISS SARL, Via Medi 7, 6932 Breganzona by registered letter with acknowledgement of receipt within 48 hours following the receipt of the Products, enclosing the parcel concerned. After this period, no claim can be taken into account.
In case of absence of the Customer during the delivery, the Customer will have to refer to the conditions of each of the delivery providers to know which are the methods to follow to recover the product.
Case of Products purchased and shipped outside Switzerland:
The Products of the website www.tinsapono.com are manufactured and distributed in accordance with the Swiss legislation in force. The responsibility of TINSAPONO SWISS SARL cannot be engaged in case of non-conformity with the legislation of another country where the Product would be shipped.
Right of withdrawal
In accordance with the legal provisions of the Swiss Consumer Code, the Customer who is a consumer does not have a withdrawal period.
Autonomy of the contract clauses
In the event that a clause of the present contract is declared inapplicable or unenforceable, the other clauses shall continue to apply and the parties to the contract shall proceed to its renegotiation in order to preserve the balance initially established.
Applicable law & Attribution of jurisdiction
The Terms and Conditions of Sale of the www.tinsapono.com website are governed, interpreted and applied under Swiss law. The language of this contract is French and in case of multilingual translation, the French version of the contract will prevail over the other versions.
In the specific case of disputes between professionals and/or merchants, the court of Lugano will be the only competent court to hear any disputes relating to these Terms of Sale, Terms of Delivery and their implementation, in particular their validity, their interpretations, their execution, their terminations and their consequences.
Responsibility
No refund, compensation or liability of TINSAPONO SWISS SARL will be applicable following an allergy or sensitivity to one of the products or for any failure related to a use or an abnormal storage of the product by negligence or fault of the consumer. In case of direct damage and which the customer will prove that they are caused by a serious fault of TINSAPONO SWISS SARL, the responsibility of TINSAPONO SWISS SARL will be limited to the price of the product concerned. TINSAPONO SWISS SARL disclaims all responsibility for the use that the buyer will make of the products.
